He was found guilty on the felony mischief and guilty of possession of the drugs, rather than trafficking. It was clear that he was not trafficking. Praise the Lord the jury understood that because the prosecution pushed hard on trafficking and that could have meant decades in jail.

The jury makes sentencing recommendations, then the judge does the actual sentencing at a later date. The jury recommended 1 year in prison for felony possession of LSD, 3 years for one of the buildings spray painted (because of the dollar amount of cleaning), and 1 year for the other building, along with restitution of $8,000. The sentences were to run consecutively so that would be 5 years in prison.

The prosecution asked whether he’d taken any steps before he ever picked up a spray can, and I don’t think they expected the answer. He had gone to protests — I saw him there. He wrote letters. He made phone calls. He walked into the media companies during business hours and asked to be heard. He tried every ordinary channel available to a citizen who believes the official account of something is wrong, and was turned away at each one.

Much of what Derek was saying then has since moved from forbidden to factual. For healthy people under 70, the infection fatality rate turned out to be comparable to a bad flu season; the mortality burden fell overwhelmingly on the oldest Americans and those with 4+ co-morbidities.

Prolonged school closures did serious and lasting damage to children — that is now close to consensus among the same institutions that once treated the suggestion as dangerous. The evidence on community masking, presented at the time as settled, never was.

The state’s attorney worked diligently to prove Derek a drug trafficker. During voir dire, juror after juror was excused after saying they would not convict anyone for selling marijuana. Even one of the state’s own expert witnesses remarked that buying in bulk is how you get the best deal.

Yesterday was mostly uneventful, although quite interesting to see the prosecutors present their evidence. Having been to most of the status hearings, I’m impressed with the judge. Very even-handed, articulate, knows the law and appears fair-minded.

You can think he chose the wrong tactic — that it handed our opponents an easy story, that it cost more than it bought — and still believe he shouldn’t stand there with empty benches behind him.

Here is what I’d ask you to weigh. Nobody was hurt. He repaired what he damaged. Whatever else is true, this was a property offense committed in a season when a great many people were frightened and furious, and he has already answered for the material part of it. What’s left is the state’s judgment on the man.

I’d also ask you to notice how you’re actually deciding. If the objection is to the act, that’s a reasoned position and I respect it. But if it’s that the act was unbecoming — too crude, too embarrassing, not the kind of thing our people do — that’s a different objection, and worth being honest with yourself about.

If you can’t be there, there are other ways to support Derek: a letter to the court, a contribution to his defense. Presence is not the only currency. But if you can be there, be there. There is substantial evidence that Monsanto knew or should have known that glyphosate could be harmful to humans, based on internal documents and scientific reviews.

• Internal documents revealed by investigative journalists and public interest groups show that Monsanto was aware of potential health risks associated with glyphosate as early as the 1970s. The company conducted internal toxicity studies on animals that showed kidney damage, organ changes, and tumor formation—evidence that was not fully disclosed to regulators.

• In the 1980s and 1990s, EPA scientists identified glyphosate as a potential carcinogen, with findings of tumors in rats and mice. Despite this, the EPA eventually approved glyphosate for use, influenced by Monsanto’s submissions and lobbying efforts.

• Ghostwritten studies were used to promote glyphosate’s safety. A landmark 2000 paper, published in Regulatory Toxicology and Pharmacology, claimed glyphosate posed no health risks to humans. DANGER: Pesticide Immunity Bill passes KY Ag Committee!

Now it goes to the Senate floor for 2 readings, then a full Senate vote.

It could get a first reading TOMORROW! They want to rush this through.

This must not pass! Here’s why:

SB199 not only gives a liability shield to glyphosate (RoundUp) but to ALL companies who manufacture any of the 57,000 CURRENT CHEMICALS as well as ALL FUTURE CHEMICALS. Forever.

*Need To Know: The EPA definition of “pesticide” includes insecticides, herbicides, rodenticides, fungicides, disinfectants and sanitizers, plant regulators, defoliants, and desiccants.

This liability shield prevents those of us harmed by these cancer-causing chemicals from suing the manufacturer.

These chemicals are not just sprayed on food crops. Glyphosate and atrazine (even worse) are routinely sprayed on school playgrounds and public parks. In fact, DeWayne Johnson, the first person to sue Monsanto over glyphosate causing his non-Hodgkins Lymphoma was the guy spraying school property! He won, even after several appeals.

Monsanto/Bayer has paid out $11B in awards with another $10B on the brink of being awarded AND another 108K cases in the works. They want relief even though they knew about the harms to humans and LIED about it to get EPA approval.

The lobbyists at yesterday’s Senate committee hearing were dismissive of these “state lawsuits” stating that they didn’t prove glyphosate caused cancer and they would continuing spraying until they see The Science. Go here to see The Science.

🐝 WHAT CAN YOU DO?

Right now is the time to double-down: call, email, and/or write your senator TODAY to oppose SB199. It takes a second and has an impact! Every Big Ag farmer is calling. Many of them were there yesterday filling the room, alongside their keeper, the Farm Bureau.

POINTS TO MAKE in your email/call/text:

Pick one or two or three of the following that speaks to YOU or just request that your Senator OPPOSE SB199! Maybe mention that Monsanto KNEW its product was harmful and lied.

• Stand for Health Freedom has an excellent pdf here — send this to your Senator!

• The 7th Amendment to the US Constitution and Section 7 of KY’s Constitution guarantees our right to trial by jury to sort our grievances. The Founders included the court system to keep us from shooting each other over harms done to us by another. SB199 flies in the face of that.

• This bill protects not just glyphosate but the current 57,000 chemicals on the market AND all FUTURE chemicals! These are found in dish soap, hand soap, personal care products, cleaning products, vaccines, all conventional wheat and bean products (granola, cookies, crackers, cereals, hummus, canned beans), and more.

• This cancer-causing chemical is routinely sprayed on school properties and public playgrounds as well as medians, sidewalks, the exterior of buildings, gardens… Imagine your kids and grandkids playing on playground wood chips soaked in glyphosate.

• $11B paid out so far in lawsuits by people harmed by glyphosate with billions more in the works.

• As Senator Funke Frommeyer (R, 24) pointed out, liability shields discourage innovation. Don’t have to do better when what you have is without consequence.

• Did you know that farmers can now kill weeds with lasers? Why not help farmers upgrade???

• Other known health effects of glyphosate:

  • Found in breast milk and umbilical cord blood

  • Linked to premature births and low birth weights

  • Glyphosate kills bugs, including the good bacteria in our guts.

  • Found in grocery store eggs and chickens from GMO feed.

  • Increases risk of liver damage in kids and adults

  • Causes permanent damage to reproductive organs affecting fertility

  • Crosses blood-brain barrier (the BBB) promoting dementias and brain inflammation

  • Present in 57% of sperm samples from infertile men

  • Exposure during pregnancy raises child’s risk of poor brain function

  • Linked to worse brain function in teens

  • Linked to severe depression and cognitive decline

  • 55% of manatees have glyphosate in their bodies (2020)

  • Linked to antibiotic resistance to hospital-inquired infections (like MRSA)

There’s no way around the fact that persistent poisoning leads to serious disatrous health effects. Glyphosate and the other 57,000 chemicals on our food and in our products are contributing to our chronic health problems. Today, 64% of American children now have a chronic health condition. Fifty years ago, it was 10%. Glyphosate was introduced in 1995.

Correlation does not prove causation, but when correlation is high enough, that’s a signal to look deeper.

We must do better.

• Excellent article about where we are headed with AI! Yes, LOTS of jobs are going away. Now is the time to focus on all the things we did to keep family in food and health before the industrial revolution. Farming, staying healthy, using home remedies, focusing on friends, community (like, ahem, tonight at Clamato’s). AI can’t replace those things. Is Candace Owens to be Trusted?

Gary at Paramount Tactical did a podcast accusing Candace Owens of lying about Charlie Kirk’s assassination and her current situation… He makes a compelling, well laid out case by simply using Candace’s own words and own footage. In this case, it doesn’t matter who Gary is or if you think you trust him. His process is straightforward, and he is only presenting a transparent way for us to see the clear discrepancies, inconsistencies, and outright mis-truths being preached as fact by Candace. It’s disappointing and disturbing but worth being aware of since she has become such a trusted source for so many of us and has the power to influence the opinions of so many. As a result, she is a target for folks who want to manipulate her to use her platform for their own ends. Candace is almost certainly well-intended but is likely being used by people with nefarious agendas. It’s worth watching the whole thing, but the first ten minutes will give you an idea of how Gary lays out his case.
