Again, my message to Senate Leadership: We will primary any GOP who doesn't honor their oath to defend the rights and liberty of the citizens...When the impeachment is handed to the Senate for trial, I ask you convict the lawbreaker and oathbreaker Andy Beshear. Revision of KRS39A is not enough. Censure is unacceptable....Leaving Andy in office is unacceptable. Only impeachment and conviction corrects and protects from the abuse he has done.
Tom, the 2020 GOP platform talks about a "rebirth of constitutional government", and it declares that the Republicans are the "party of the Constitution". It holds the Constitution as a sacred "covenant" and a "compact"...in modern terms a "contract". This contract between the citizens and their Government may be defended by either party when one party is in breach. The State Government is on notice that they are in breach of contract. How the contract will be defended is largely up to the House and Senate in this circumstance. But if the government fails to defend the contract, the people will. The LRC bulletin on impeachment, (see link below), supports the check that the House has in the "sole" power of impeachment, and gives broad latitude for the House to determine what is or isn't a misdemeanor. Andy has broken the law and other Courts have already opined as much. James Madison, oft regarded as "the Father of the (U.S.) Constitution" said in his essay "Property" that the people have Property in our rights. Meaning our rights are as much, or more so, our private property as our physical, tangible private property. Andy made a MAJOR theft of the people's rights and needs to be held accountable. But if you need a statute violation, look to KRS 522.030.
If the people's representatives were willing to impeach over the use of State aircraft, how much more so from the theft of people's rights?

522.030 Official misconduct in the second degree.
(1) A public servant is guilty of official misconduct in the second degree when he knowingly:
(a) Commits an act relating to his office which constitutes an unauthorized exercise of his official functions; or
(b) Refrains from performing a duty imposed upon him by law or clearly inherent in the nature of his office; or
(c) Violates any statute or lawfully adopted rule or regulation relating to his office.
(2) Official misconduct in the second degree is a Class B misdemeanor.
