Who’s That Candidate Update from Clyde Zoph
Clyde Zoph here, with important Who's That Candidate? updates.
As you know, 2025 is our implementation year - we've waited what seems forever. We have recently made two very significant, strategic changes to our original plan, and need to keep you apprised.
First: our "Paper the State" phase - in which we place yard signs at key traffic ingress/egress points - was originally slated to commence March 1. As a practical matter, our launch date has been changed to April 1, in consideration of March's unpredictable temperatures.
Second: our original plan was to have a presence in every county, state-wide.
After careful deliberation and extensive analysis, we have decided that our preliminary targets will be regional instead, for a variety of factors.
Our focus is now on the 30 counties which comprise our South Central region. We believe our new focus will yield optimum results, because we'll be in the counties where our passionate base resides. Further, our targets are now both House and Senate, based on reputation and trusted legislator consultation.
We thank you for your continued support, and need you now more than ever!
We can only Make Kentucky Great Again with you!

Derek Nance Trial Upate: Hearing this Friday, Trial Continued, New Trial Date TBD
Please join us this Friday, February 14th at 9:30 a.m. for the next chapter in Derek’s court case. It has been an interesting journey and quite the education in the judicial system. Come if you can. Our support is always appreciated.
The Circuit Courthouse is on the corner of Main and Limestone in Lexington. Parking garages can be found across Main Street at the Lexington Public Library and one block North (around the corner from the Limestone Courthouses) on Barr Street.
The pretrial hearings have typically been on the 2nd floor in Courtroom D, but you can verify when you get there. Look for Judge Travis.

From Derek: Greetings Mafa friends! This is an important announcement. Since April of 2021, I’ve been under indictment by the state of Kentucky over my efforts to expose the crimes of the State committed under the false pretext of a manufactured pandemic crisis. I have spent the last few years fighting with prosecutors in countless hearings for the right to a fair trial.
I am seeking a trial by jury, praying for the opportunity to publicly clear my name and testify on record to expose the serious criminal violations committed by those who used a manufactured pandemic to transfer trillions in wealth to mega corporations, while terrorizing the public into receiving potentially dangerous injections.
I’m reaching out to friends and allies who have also suffered from the criminal actions of government and corporate organizations under the manufactured crisis of Covid 19 to see if anyone is interested in testifying about their experience as a witness at my upcoming trial.
Not everyone who has been aggrieved would be able to testify, and if you are not able to testify in person, I will also be collecting affidavits to present before the court from those like myself who challenge the official lies regarding Covid’s origins and demand a thorough and transparent investigation.

Invitation to February 22nd Robot Gladiator Leage Melee
Robot Gladiator League is a fun, family-friendly, combat robotics spectator sport that gives students hands-on, project-based, STEM workforce skills. The February 22nd RGL Melee will be held at the University of Kentucky on the same day as Engineering Day, when hundreds of exhibits from dozens of organizations and the engineering colleges will offer activities and demos for elementary, middle, and high school students. E-Day at UK is 10:00 to 2:00 in the Engineering Quadrangle. The Robot Gladiator League melees will run 10:00 to 3:30 at the Gatton Student Center Ballroom. Both events are free and open to the public, so free bring the whole family!

The Institute for Justice, the most inspiring liberty group in the country (ij.org), is a nonprofit, public interest law firm whose mission is to end widespread abuses of government power and secure the constitutional rights that allow all Americans to pursue their dreams.
We are working with IJ Attorneys Rob Johnson and Michael Soyfer, whose work at IJ is focused on government surveillance, civil forfeiture, and accountability for government officials who abuse their power. Many of you heard Michael at a recent MAFA meeting, and were inspired by his work and message.
As Kentuckians, we have a rare opportunity to not only help the very worthwhile IJ, but also to be an active participant in securing our Constitutional liberties through our participation as plaintiffs! So often, especially those of us who gather at our Make Americans Free Again meetings, we wonder what we might actually do to support liberty and our Constitution as we watch in dismay at the breakdown and degeneration of our beloved country. AAPS seeks to block the requirement that Americans provide their personal information to federal agencies beginning Jan 1, 2025 (thanks, Tina!)
The Association of American Physicians and Surgeons (“AAPS”) served a lawsuit on Oct 11, seeking to block the upcoming requirement that tens of millions of Americans provide their personal information to federal agencies beginning Jan 1, 2025. The Corporate Transparency Act (CTA) imposes this new reporting requirement on more than 30 million entities such as small businesses, sports clubs, civic groups, and political organizations.
The CTA comprised only 21 pages, camouflaged among nearly 1,500 total pages in a rushed, end-of-year annual appropriation in 2020. With its threatened punishment of two years in federal jail, the CTA requires that tens of millions of ordinary, law-abiding Americans report their home addresses, birthdates, and driver’s license or similar personal identifying numbers to the federal Financial Crimes Enforcement Network (“FinCEN”), the Complaint states.
FinCEN will then create a massive new federal database for monitoring everyday Americans. Federal investigatory jurisdiction would vastly expand under this law, AAPS’s lead counsel, Andrew Schlafly states. “Most Americans are unaware of this extension in the reach of the federal government into purely local activities. This is the Orwellian Big Brother on steroids.”
AAPS filed this lawsuit in Amarillo, Texas. Small medical practices there and nationwide are being subjected to monitoring by the federal government in D.C.
“Nothing in the Constitution authorizes the federal government to monitor small medical practices and other local entities like this,” Mr. Schlafly points out. “Never before has the federal government been allowed to have such a broad police power over local activities,” he added.
Large businesses are exempt from the CTA if they have more than 20 full-time employees and more than $5 million in gross revenue. Also exempt are 501(c) organizations, such as recognized 501(c)(3) charity groups, as are political action committees (PACs) that support or oppose candidates for office.
“These exemptions are far too narrow, and this new requirement applies to most small entities,” Mr. Schlafly said. “This new law improperly chills the freedom of association that is essential to other freedoms.”
AAPS’s lawsuit is pending in U.S. District Court in Amarillo, No. 2:24-cv-210-Z.
Vaccine Custody Disputes (thanks, Tina!)
Chances are that your attorney does not know this. Please share with friends in custody disputes!
Vaccines are the only issue in child custody disputes where the law already gives us the answers. State statutes tell us what vaccines are required and when, and who can opt out and how. So, most of the time, the only thing a judge needs to do is determine whether all concerned are in compliance with the law. If everyone is—if the children get any required vaccines or are legally exempt—the dispute is over; there’s nothing more a judge needs to do or legally can do.
State laws allow individual parents to exercise an exemption. If “best interests law” = “vaccinate the child” while “exemption law” = “a parent can legally refuse vaccines for the child,” these two laws are in conflict. How do we resolve this conflict? Our legal systems have statutory construction rules that tell us how to resolve conflicting statutes. These rules say that when a general statute (here, the “best interests” statute) conflicts with a specific statute (here, the exemption statute), the specific statute supersedes or “trumps” the general statute. The exemption statute “wins,” automatically, as a matter of law. So, when parents disagree, if one parent has exercised a lawful exemption, that’s the end of the matter. Family law judges’ authority from a general “best interests” statute doesn’t allow them to override a parent’s right from a specific exemption statute. It really is that simple.
